A Certificate of Compliance (CoC) is the official confirmation from the BC Ministry of Environment and Climate Change Strategy that a contaminated site has been investigated and either remediated to meet applicable standards or assessed to demonstrate that contamination does not pose an unacceptable risk.

  • Property value - a site with a CoC is significantly more valuable than one with unresolved contamination
  • Development approval - many municipalities require a CoC before issuing building permits on formerly contaminated land
  • Financing - lenders require certainty about environmental condition

The Process

  1. Preliminary investigation - Phase 1 and Phase 2 ESAs to define contamination extent
  2. Detailed site investigation - comprehensive characterization of all contaminants and media
  3. Remediation or risk assessment - either clean up to numerical standards or demonstrate acceptable risk
  4. Confirmation sampling - verify remediation goals have been met
  5. Approval in Principle (AiP) - submit application to Ministry, receive conditional approval
  6. Certificate of Compliance - issued after all conditions are satisfied

Cost and Timeline

The cost of obtaining a CoC depends entirely on the site conditions:

  • Simple sites (limited contamination, numerical closure): $50,000-$150,000 total investigation and remediation
  • Complex sites (groundwater plumes, multiple contaminants): $200,000-$1,000,000+
  • Risk-based closure (no excavation, risk assessment approach): $75,000-$200,000

Timeline ranges from 6 months to several years depending on complexity and Ministry review times.
