Stormwater runoff from construction sites is one of the most regulated environmental aspects of building in British Columbia. Uncontrolled sediment discharge is the single most common environmental violation on construction projects, and enforcement is increasing.
Why Stormwater Matters on Construction Sites
When you strip vegetation and expose soil, rainfall creates sediment-laden runoff. That sediment:
- Smothers fish habitat in receiving streams
- Triggers Fisheries Act violations (federal offence)
- Clogs municipal storm drains
- Creates turbid discharge visible to regulators and the public
A single rainfall event on an unprotected site can generate a complaint, an inspection and a violation notice within 24 hours.
Erosion and Sediment Control (ESC) Requirements
Most BC municipalities and Metro Vancouver require an Erosion and Sediment Control Plan before any land clearing. The plan must include:
- Site grading and drainage plan
- Location of all ESC measures (silt fence, sediment ponds, check dams)
- Stabilized construction entrance
- Temporary and permanent seeding/stabilization schedule
- Inspection and maintenance procedures
- Spill prevention and response plan
Common ESC Measures
- Silt fence - perimeter control to filter runoff at property boundaries
- Sediment ponds/traps - temporary basins to settle suspended solids
- Check dams - slow water velocity in drainage channels
- Rock construction entrance - prevent mud tracking onto public roads
- Hydroseeding/erosion blankets - stabilize exposed slopes
- Turbidity curtains - for work near water bodies
Inspection Requirements
ESC measures must be inspected:
- After every rainfall event exceeding 10mm
- Weekly during active construction
- Before and after any land disturbance activity
- Documented with photos, dates and corrective actions
Penalties for Non-Compliance
- Municipal bylaw fines: $500-$10,000 per offence
- BC Environmental Management Act: up to $200,000 and/or imprisonment
- Federal Fisheries Act: up to $1,000,000 for first offence (indictable)
